California Workers’ Rights to Meal and Rest Breaks

California workers have important rights when it comes to meals and rest breaks during the workday. In most cases, employees who work more than five hours in a day are entitled to an unpaid 30-minute meal break. Workers are also generally entitled to a paid 10-minute rest break for every four hours worked, or major fraction thereof.

Under California labor law, employers must authorize and permit employees to take legally required meal and rest breaks and may not discourage or interfere with workers from using them. These breaks are important for protecting employees’ health, safety, and overall well-being in the workplace. 

If required breaks are not provided, California law may allow employees to receive additional compensation, depending on the circumstances and applicable wage and hour rules.
